I defend a novel account of scientific progress centred around justification. Science progresses, on this account, where there is a change in justification. I consider three options for explicating this notion of change in justification. This account of scientific progress dispels with a condition for scientific progress that requires accumulation of truth or truthlikeness, and it emphasises the social nature of scientific justification.

Both Maimonides and St. Thomas Aquinas occupy a unique position in their respective religious milieux. Each aimed to reconcile Aristotelian thought with the theology of his own faith. Their gigantic endeavors did not meet with immediate and unanimous approval among the conservative spokesmen of their coreligionists. Efforts had been made already within their lifetimes to have their views censored. Maimonides’s Guide to the Perplexed, completed in 1185 raised bitter controversies among Jews, and for a century at least almost every Jewish (...) scholar of note was either an ardent opponent or an equally ardent apologist for the Sage of Cordova. Enmity between both parties was heated to such a point that the dispute was referred by the anti-Maimonists in 1234 to a Christian authority, the papal legate at Montpellier, who ordered Maimonides’s works to be burned. When the controversy quieted down, Maimonides’s works became the centre of Jewish thought throughout the ages. (shrink)

Psychology thus serves as the path to his philosophy and leads to a reconstruction of his substantive theses, including the morality of positive power. The article analyses the constitution of subjectivity in Ruben Östlund’s film Force Majeure. At the centre of attention stands the male protagonist who is uncapable of reconciling his inner nature with the external expectations. If the film may be un- derstood as a critique of existing middle-class conventions, it also reproduces a highly conventional ideal of the self-identical subject. The article argues that this confusion or irony is an expression of a Cartesian subject – still prevalent in the film (...) – in crisis. A neglected aspect of Descartes’ theory is that the autonomy of the subjects presupposes the existence of God. The problem for Östlund’s char- acters is that there is no God. Still, they act as if he, or as if any au- thority might, legitimize their subjectivity. Thus, the whole existence becomes a series of performances. The idea of an inner nature cor- responds with the notion of an outer nature. The latter is certainly very present in Force Majeure, but at the same time this nature is constantly problematized. On an allegorical level, the film may thus be read as a comment on the Anthropocene, a state where we no longer know neither what “nature”, nor “culture” is. (shrink)

Often, a more or less universal quality is attributed to certain legal concepts. For refugee scholars working between 1933 and 1945, the universal quality of these concepts was challenged on two fronts: first, the breaking down of the Weimar Constitution and the German Rechtsstaat under Nazi rule demonstrated the fragility of a constitutional and legal order. Moreover, the breakdown of the German Rechtsstaat was felt on a deeper conceptual level. ‘Immutable’ legal concepts turned out to be easily mutated to conform (...) to Nazi ideology. The second major challenge to the universality of concepts thus pertains to the universal characteristics of the ‘concept of a concept’ itself. In brief, what German refugee legal scholars attempted to create in the course of the 1930s and 1940s was a ‘universal’ Rechtsstaat centred around concepts and legal scholarship that would avoid the breakdown by placing it into a feasible and balanced system of legal enforcement on an international level. Thus, in their new academic context, rather than dismissing the Rechtsstaatliche function of legal concepts and the role of legal scholars, refugee scholarship ventured to enhance it. This contribution argues that the development of Hersch Lauterpacht’s concept of human rights constitutes such an enhancement. (shrink)

I explore Martin Heidegger’s figure of the last god found in his middle period of thinking from 1936–1939 centring my analysis on Contributions to Philosophy: Of the Event (Beiträge) and how this conception is messianic in nature. The last god is a particular instantiation of a being among beings rather than representing a literary or philosophical structure that lies ahead in the future. I emphasise the notion of the turning that occurs within Ereignis, a revived playfulness, wherein the lightning-flash (das (...) Blitzen) appears as a trace or guide towards a new beginning. I conclude by investigating the historical and cultural ramifications that the arrival of the last god would have. (shrink)

AbstractThe Green Revolution still exerts an important influence on agricultural policy as a technology-centred development strategy. A main policy narrative underpinning the Green Revolution was first expounded in Transforming Traditional Agriculture, a book published in 1964 by Nobel Prize-winning economist Ted Schultz. He famously argued that traditional farmers were ‘poor but efficient’. As farmers responded to economic incentives, technology-driven strategies would transform traditional agriculture into an engine of economic growth. Schultz relied on published ethnographic data and his own calculations to (...) construct this policy narrative. My reanalysis of TTA focuses on its main case study, Panajachel, a village in Guatemala. I follow a narrative approach, evaluating whether Schultz’s story relates a plausible account of agricultural development in Panajachel and its region. I show how Schultz deliberately tried to hide that Mayan farmers in Panajachel were not challenged in technological terms and were able to reach relatively high economic returns. His interpretation of the Guatemalan rural economy ignored ethnic tensions dominating market exchange, a main barrier for agricultural development. I evaluate Schultz’s narrative further by tracing the subsequent evolution of Panajachel and its wider region. High-input strategies had to address ethnic barriers and change agents became embroiled in violent conflict along ethnic lines. Assessing the adequacy of Schultz’s contribution, from a narrative approach, shows how he ‘got the story wrong’ and that the Green Revolution policy narrative has an excessively narrow intellectual basis. New narratives should reserve a much more important place for institutional change in agricultural development. (shrink)

An implicit assumption in most works on change recipient reactions is that employees are self-centred and driven by a utilitarian perspective. According to large parts of the organizational change literature, employees’ reactions to organizational change are mainly driven by observations around the question ‘what will happen to me?’ We analysed change recipients’ reactions to 26 large-scale planned change projects in a policing context on the basis of 23 in-depth interviews. Our data show that change recipients drew on observations with three (...) foci to assess change, making sense of change as multidimensional and mostly ambivalent in nature. In their assessment of organizational change, recipients care not only about their own personal outcomes, but go beyond self-interested concerns to show a genuine interest in the impact of change on their colleagues and organization. Meaningful engagement of employees in organizational change processes requires recognizing that reactions are not simply ‘all about me’. We add to the organizational change literature by introducing a behavioural ethics perspective on change recipients’ reactions highlighting an ethical orientation where moral motives that trigger change reactions get more attention than is common in the change management literature. Beyond the specifics of our study, we argue that the genuine concern of change recipients for the wellbeing of others, and the impact of the organizations’ activities on internal and external stakeholders, needs to be considered more systematically in research on organizational change. Globalisation develops at a staggering pace that envelopes and infiltrates local South African communities in various ways. Through technology a person can have access to anything today. Should the church try to keep up, or compete with such a reality? This article aims to encourage the church to develop a responsible missional character, which embraces the opportunities globalisation offers – to be a participative forum in a community comprising of more than religious people. Through re-evaluating the church’s missional intent, by (...) shifting the paradigm away from self-centred outcomes, the church should contribute to such a community’s articulation of faith. Narrative is everywhere and has unique powers: to enchant and inspire, to make sense of our lives and ourselves and to afford us an enriched understanding of alternative worlds and lives and of better futures - though narrative also has the potential to coerce and oppress. Narrative is at the centre at all stages of the English curriculum and has been the subject of a burgeoning critical industry. This timely volume addresses the many ways in which recent thinking has (...) informed the teaching of narrative in university classrooms in the UK and the USA. Distinguished teachers from both countries range widely across narrative topics and genres, including the opportunities opened up by new technologies, and chapters articulate students' own individual and collaborative experiences in the teaching/learning process. The result is a volume that explores the pleasurable challenges of working with students to help them appreciate and assess the power that narrative exerts, to become reflective critics of its inner workings as well as exponents of narrative themselves. Abstract This paper argues that in modern (agro)biotechnology, (un)naturalness as an argument contributed to a stalemate in public debate about innovative technologies. Naturalness in this is often placed opposite to human disruption. It also often serves as a label that shapes moral acceptance or rejection of agricultural innovative technologies. The cause of this lies in the use of nature as a closed, static reference to naturalness, while in fact “nature” is an open and dynamic concept with many different meanings. We (...) propose an approach for a dynamic framework that permits an integrative use of naturalness in debate, by connecting three sorts of meaning that return regularly in the arguments brought forward in debate; cultural, technological, and ecological. We present these as aspects of nature that are always present in the argument of naturalness. The approach proposes a dynamic relation between these aspects, formed by gradients of naturalness, which in turn are related to ethical concerns. In this way we come to an overview that makes it possible to give individual arguments a relative place and that does justice to the temporality of the concept of nature and the underlying ethical concerns stakeholders have in respect to innovation in agriculture. This article stems from my presentation at the 2020 Symposium of the Kripke Center for the Study of Religion and Society, whose theme was "Religion and the New Politics." The article is written for an interdisciplinary audience. Drawing on resources from the philosophical tradition of phenomenology and putting them into dialogue with an important theme in Christian theology, I argue that there is a distinctly non-discursive, embodied form of racism that should be recognized and addressed by the new politics. Because (...) this form of racism occurs not at the familiar level of discourse (word), but in the often unconscious habitualities of the lived body (flesh), it resists common antiracist strategies, and seems to be outside the purview of responsibility and of willful, rational change (the logos). I situate these underlying issues with regard to the traditional opposition between mind and body, and then offer a reinterpretation of them by way of some key phenomenological concepts: intentionality, the lived body, the critique of scientism, motivation, and empathy. I conclude that embodied racism is something which is open to an extended conception of rationality that includes the lived body, and for which we are responsible. I then suggest some antiracist political strategies that put these theoretical considerations to use through attention to embodied spaces and practices. (shrink)

I propose an experiment that may be performed, with present low temperature and cryogenic technology, to reveal Wheeler’s quantum foam. It involves coupling an optical photon’s momentum to the center of mass motion of a macroscopic transparent block with parameters such that the latter is displaced in space by approximately a Planck length. I argue that such displacement is sensitive to quantum foam and will react back on the photon’s probability of transiting the block. This might allow determination of the (...) precise scale at which quantum fluctuations of space–time become large, and so differentiate between the brane-world and the traditional scenarios of spacetime. Gender‐affirming care is almost exclusively discussed in connection with transgender medicine. However, this article argues that such care predominates among cisgender patients, people whose gender identity matches their sex assigned at birth. To advance this argument, we trace historical shifts in transgender medicine since the 1950s to identify central components of “gender‐affirming care” that distinguish it from previous therapeutic models, such as “sex reassignment.” Next, we sketch two historical cases—reconstructive mammoplasty and testicular implants—to show how cisgender patients offered justifications grounded (...) in authenticity and gender affirmation that closely mirror rationales supporting gender‐affirming care for transgender people. The comparison exposes significant disparities in contemporary health policy regarding care for cis and trans patients. We consider two possible objections to the analogy we draw, but ultimately argue that these disparities are rooted in “trans exceptionalism” that produces demonstrable harm.. (shrink)

It seeks to establish the ideological basis of Progressive halakhah, and its application to daily life. The Institute fosters serious studies, and helps scholars in various portions of the world to work together for a common cause. The foremost halakhic scholars in the Reform, Liberal, and Progressive rabbinate along with some Conservative and Orthodox colleagues as well as university professors serve on our Academic Council. This collection of essays is the product of the symposia held in Atlanta and Pittsburgh in 1995 and 1996. In this paper, we will critically examine the notion of rationality and the disabling instinct of self-preservation that play out in human relationships. That “man is a rational animal,” as Aristotle declared is usually taken for granted in social studies. But whether humans act rationally all the time, and in all circumstances remains questionable. Here, we shall investigate this concern from a decolonial perspective by engaging some contradictions thrown up in the context of coloniality within which a section of humanity (...) dehumanizes the rest. The question then is, how rational is the intellectual program of coloniality? Taking a cue from conversational thinking that places the notion of relationship at the center of decolonial analysis, we argue that coloniality fractures the inter and intra-racial relationships due mainly to the instinct of self-preservation that overwhelms human rationality. What has emerged today as the superior/inferior divide, racialism, classism, internal colonialism, ethnic cleansing, apartheid, xenophobia, and genocide are some of the consequences of warped and uncritical thinking driven by an extreme form of the instinct of self-preservation. We argue that the promotion of critical (higher-order) thinking in addition to ordinary (lower-order) thinking could be crucial in a decolonial program. (shrink)

Human vision raises a number of puzzles. Among them are the puzzles of visual experience: how to provide a scientific understanding of the phenomenal character of the visual experiences of the shapes, textures, colors, orientations and motion of perceived objects? How can a purely subjective visual experience be the basis of so much objective knowledge of the world? Visually guided actions raise a different puzzle: how can actions directed towards a target be so accurate in the absence of the agent’s (...) awareness of many of the target’s visual attributes? Ways of Seeing has three related goals, the first of which is to make the case for a broadly representational approach to the above set of puzzles. The second goal of WoS is to argue that the version of the ‘two-visual systems’ model of human vision best supported by the current empirical evidence has the resources to solve the puzzle of visually guided actions, which has been at the center of much recent work in the cognitive neuroscience of vision and action. The third goal of WoS is to draw attention to some of the tensions between acceptance of the two-visual systems model of human vision and some influential views about the nature and function of the content of visual experience espoused by philosophers in response to the puzzles raised by visual experience. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. For all of the emphasis on quality improvement—as well as the acknowledged overlap between assessment of the quality of healthcare services and clinical ethics—the quality of clinical ethics consultation has received scant attention, especially in terms of empirical measurement. Recognizing this need, the second edition of Core Competencies for Health Care Ethics Consultation identified four domains of ethics quality: (1) ethicality, (2) stakeholders’ satisfaction, (3) resolution of the presenting conflict/dilemma, and (4) education that translates into knowledge. This study is the (...) first, to our knowledge, to directly measure all of these domains. Here we describe the quality improvement process undertaken at a tertiary care academic medical center, as well as the tools developed to measure the quality of ethics consultation, which include post-consultation satisfaction surveys and weekly case conferences. The information gained through these tools helps to improve not only the process of ethics consultation, but also the measurement and assurance of quality. (shrink)

In his recent book “Becoming Human” Michael Tomasello delivers an updated version of his shared intentionality (SI) account of uniquely human cognition. More so than in earlier writings, the author embraces the idea that SI shapes not just our social cognition but all domains of thought and emotion. In this critical essay, we center on three parts of his theory. The first is that children allegedly have to earn the status of “second persons” through the acquisition of collective intentionality at (...) age 3. We make the case that humans take a second-personal stance toward others even as infants. The second point concerns Tomasello’s claim that 3-year-olds are group-minded and think in terms of “us” vs. “them”. We doubt both that children this young have a clear overview of their in- and out-groups and that they possess the “agonistic spirit” necessary for inter-group competition. Third, due to his focus on collective intentionality and how it might explain 3-year-olds’ difficulties with theory of mind problems, Tomasello appears to pay less attention to the crucial conceptual change that allows 4- to 5-year-olds to master such tasks. A platitude that took hold with Kuhn is that there can be several equally good ways of balancing theoretical virtues for theory choice. Okasha recently modelled theory choice using technical apparatus from the domain of social choice: famously, Arrow showed that no method of social choice can jointly satisfy four desiderata, and each of the desiderata in social choice has an analogue in theory choice. Okasha suggested that one can avoid the Arrow analogue for theory choice by employing a strategy (...) used by Sen in social choice, namely, to enhance the information made available to the choice algorithms. I argue here that, despite Okasha’s claims to the contrary, the information-enhancing strategy is not compelling in the domain of theory choice. (shrink)

In 1655 La Peyrère was the first to substantially argue for and popularize polygenism—the view that God created multiple original human mating pairs in separate acts of creation with numerous created before Adam. Positing or rejecting polygenism has been central to modern theorizing about human types and origins. Prominent recent interpreters have maintained that La Peyrère’s polygenism does not imply a hierarchy of human types. This paper reconstructs La Peyrère’s account and, in opposition to the dominant view, argues that his (...) polygenism produces a human species hierarchy. The Adamite species is superior to the Pre-Adamite species in virtue of its material composition, mode of creation, and form. Medical scientists employ ‘quality assessment tools’ (QATs) to measure the quality of evidence from clinical studies, especially randomized controlled trials (RCTs). These tools are designed to take into account various methodological details of clinical studies, including randomization, blinding, and other features of studies deemed relevant to minimizing bias and error. There are now dozens available. The various QATs on offer differ widely from each other, and second-order empirical studies show that QATs have low inter-rater reliability and low inter-tool reliability. This (...) is an instance of a more general problem I call the underdetermination of evidential significance. Disagreements about the strength of a particular piece of evidence can be due to different—but in principle equally good—weightings of the fine-grained methodological features which constitute QATs. Low sexual desire in females has been medicalised, pathologised as a disease, and intervened upon with a range of pharmaceuticals. There are two polarised positions on the medicalisation of low female sexual desire: I call these the mainstream view and the critical view. I assess the central arguments for both positions. Dividing the two positions (...) are opposing models of the aetiology of low female sexual desire. I conclude by suggesting that the balance of arguments supports a modest defence of the critical view regarding the medicalisation of low female sexual desire. (shrink)

This article examines the recent trial of ANC president Jacob Zuma, and how gender power was framed in respect to, and within, the politics of culture. The trial centred on allegations of rape by Zuma of an HIV positive woman many years his junior, who was also the daughter of a former anti-apartheid struggle comrade. All of these details were considered pertinent, not only to the legal debates about whether a crime had been committed, but also to the political (...) debates raging around the nation's key challenges of high rates of sexual violence and the 'denialist' state response to devastating levels of HIV infection. Many Zuma supporters saw the accusation of rape as politically motivated and as evidence of an anti-Zuma conspiracy. In visibly smaller numbers, women's rights groups were present on the streets as well, trying to draw attention to the general problem of the nation's extraordinarily high rates of sexual violence and the general failure of the justice system to address cases of rape. The article argues that the fervour surrounding this trial, the burning political question of women's status was continually cast as a private matter: debates about relations between men and women came to be focused on issues of propriety, behaviour and etiquette rather than on questions about rights and power. In short, the privatisation of gender was effected through the politics of culture. As culture is politicised as a legal and secular 'right', gender is de-politicised to become a normatively 'private' and 'customary' domain. This is not merely a South African dilemma, but a dilemma which is con-concomitant to the social conditions of modernity itself. (shrink)

Medical nihilism is the view that we should have little confidence in the effectiveness of medical interventions. Jacob Stegenga argues persuasively that this is how we should see modern medicine, and suggests that medical research must be modified, clinical practice should be less aggressive, and regulatory standards should be enhanced.

An astonishing volume and diversity of evidence is available for many hypotheses in the biomedical and social sciences. Some of this evidence—usually from randomized controlled trials (RCTs)—is amalgamated by meta-analysis. Despite the ongoing debate regarding whether or not RCTs are the ‘gold-standard’ of evidence, it is usually meta-analysis which is considered the best source of evidence: meta-analysis is thought by many to be the platinum standard of evidence. However, I argue that meta-analysis falls far short of that standard. Different meta-analyses (...) of the same evidence can reach contradictory conclusions. Meta-analysis fails to provide objective grounds for intersubjective assessments of hypotheses because numerous decisions must be made when performing a meta-analysis which allow wide latitude for subjective idiosyncrasies to influence its outcome. I end by suggesting that an older tradition of evidence in medicine—the plurality of reasoning strategies appealed to by the epidemiologist Sir Bradford Hill—is a superior strategy for assessing a large volume and diversity of evidence. Robustness is a common platitude: hypotheses are better supported with evidence generated by multiple techniques that rely on different background assumptions. Robustness has been put to numerous epistemic tasks, including the demarcation of artifacts from real entities, countering the “experimenter’s regress,” and resolving evidential discordance. Despite the frequency of appeals to robustness, the notion itself has received scant critique. Arguments based on robustness can give incorrect conclusions.
